Reservation Conditions for Holiday Apartments and Holiday Homes

1. Booking and Conclusion of Contract

Upon confirmation of the booking, a binding rental agreement is concluded between the guest and the intermediary agency HolAp SA or the respective owner of the accommodation.
HolAp SA acts as an intermediary in the name and on behalf of the owner or service provider and sends the guest a written booking confirmation.

The booking becomes binding once it has been confirmed in writing (by e-mail or via a booking portal).

If the booking confirmation or invoice deviates from information published online or in other publications, the guest acknowledges the conclusion of the contract based on the booking confirmation by making the payment.

Special requests or verbal agreements are only binding if confirmed in writing by HolAp SA.

2. Prices, Additional Costs and Booking Fee

The published seasonal prices apply per week or per stay for the entire rental property.
As a rule, ancillary costs (e.g. final cleaning, linen and booking fee) are included, unless otherwise stated in the property description.
The information contained in the booking confirmation shall always be decisive.

3. Payment Conditions

An advance payment of 30% of the total price is due no later than 10 days after receipt of the booking confirmation.
The remaining balance must be paid no later than 30 days prior to arrival.

For bookings made within 30 days prior to arrival, the total rental price is due immediately upon receipt of the booking confirmation.

If payment is not made on time, HolAp SA is entitled, after an unsuccessful reminder, to withdraw from the contract. In such case, the cancellation conditions according to clause 12 shall apply.

After receipt of the full payment, but no earlier than 28 days before the start of the rental period, the guest will receive the rental voucher, including address, directions and key collection details.

4. Number of Occupants

The rental property may only be occupied by the number of persons stated in the booking confirmation (children included).
The owner or key holder is entitled to refuse admission to additional persons.

5. Pets

One pet may be brought along only if expressly stated in the booking confirmation (partly against an additional fee).
Additional pets are not permitted unless expressly approved in writing by HolAp SA.

6. Duration of Stay and Arrival / Departure

The minimum stay is 5 nights, or 3 nights for bookings made within 21 days prior to arrival, unless otherwise agreed.

Arrival is from 4:00 p.m., and departure must take place by 10:00 a.m. at the latest.

7. Liability of the Tenant

The tenant undertakes to treat the rental property and its inventory with due care and to comply with the house rules.
The tenant is liable for any damage caused by themselves or by accompanying persons.

Any damage must be reported immediately, at the latest upon return of the rental property.
Subsequently discovered damage may be charged to the tenant if it can be demonstrably attributed to them.

8. Complaints

Any defects discovered on site must be reported in writing to HolAp SA within 72 hours of arrival.
Damage caused by the guest must be reported in writing within 7 days after departure.

Claims made thereafter, including claims for price reduction or damages, will not be considered.

9. Events Beyond the Control of HolAp SA

HolAp SA assumes no liability for events beyond its control (e.g. natural disasters, strikes, political unrest, power or water outages, blocked access roads, construction noise, etc.).
In such cases, the tenant has no right to terminate the contract, reduce the rental price or claim damages.

10. Liability of HolAp SA

If the booked accommodation is unavailable due to unforeseeable or unavoidable circumstances (e.g. fire, water or natural damage), HolAp SA reserves the right to offer a comparable replacement accommodation or to cancel the contract with reimbursement of payments already made.

Claims for damages are limited to the amount of the agreed rental price.
HolAp SA accepts no liability for damages, losses, theft or omissions caused by third parties.

11. Cancellation Protection

To protect against financial losses due to a serious event, cancellation protection may be taken out.
A fee of 3% of the rental price will be charged for this service.

Serious events include:

  • serious illness, accident or death of the guest, a travelling companion or a direct family member;
  • serious damage to the guest’s property at their place of residence due to fire, water, natural events or burglary.

Events related to Covid-19 are excluded.

The cancellation protection begins on the date of final booking and ends on the day of arrival.
Booking fees and cancellation protection fees are payable in all cases.

12. Cancellation / Withdrawal by the Guest

The Guest may withdraw from the rental agreement in writing at any time prior to arrival. For the purpose of calculating the cancellation period, the date of receipt of the written cancellation by HolAp SA shall be decisive.

12.1 Cancellation Conditions for Direct Bookings

For bookings made directly with HolAp SA (via the website, email, telephone, or other direct distribution channels), the following cancellation conditions shall apply and be deemed contractually agreed:

  • up to 30 days prior to arrival: free of charge (excluding the booking fee);
  • from 29 days prior to arrival or in the event of non-arrival (no-show): 100% of the total price (excluding the booking fee).

12.2 Bookings Made via Third-Party Platforms

Where a booking is made via a third-party platform (e.g. online travel platforms or intermediary portals), only the cancellation and payment conditions stated during the booking process of the relevant third-party platform shall apply.

HolAp SA has no control over such conditions. Any cancellation provisions of the third-party platform that differ from these General Terms and Conditions shall prevail over these General Terms and Conditions.

Any payments already made shall be set off against the applicable cancellation charges.

13. Re-Rental / Credit

HolAp SA will endeavour to re-let the accommodation after a cancellation.
If successful, the revenue generated, minus a processing fee of CHF 100, will be credited against the cancellation costs.

The guest has no entitlement to re-rental.

14. Long-Term Stays (from 28 Nights)

For stays of more than 28 nights, the following conditions apply:

  • free cancellation up to 60 days prior to arrival
  • thereafter forfeiture of the deposit
  • from 30 days prior to arrival: 100% of the total price

In the event of early departure, no refund will be granted.

15. No-Show

If the guest fails to arrive without prior cancellation, this shall be deemed a cancellation on the day of arrival.
The full rental price is due.

16. Price and Property Description Changes

Price changes and amendments to the property description are reserved, in particular due to changes in statutory charges, significant currency fluctuations or comparable circumstances.

17. Final Provisions

Swiss law shall apply.
Place of jurisdiction is Locarno, insofar as legally permissible.

Should any provision be or become invalid, the validity of the remaining provisions shall remain unaffected.
