Terms and Conditions for Holiday Apartments and Holiday Homes
These Terms and Conditions govern all bookings of holiday apartments and holiday homes (hereinafter referred to as the Property) arranged through HolAp SA (hereinafter referred to as HolAp, we, or us). By making a booking, the contracting party (hereinafter referred to as the Tenant) agrees to be bound by these Terms and Conditions.
1. Booking and Conclusion of Contract
Upon receipt of the Tenant’s booking—whether by telephone, in writing (letter, fax, or email), or made personally or orally—the booking and, consequently, the contract shall be deemed concluded.
HolAp acts solely as an intermediary and enters into the contract on behalf of the Owner or Service Provider. A written booking confirmation will be issued by HolAp to the Tenant. From this point onwards, the rights and obligations arising from the contract and from these Terms and Conditions become binding upon both the Tenant and HolAp.
If the booking confirmation or invoice deviates from the online or published description, payment by the Tenant shall constitute acceptance of the contract in accordance with the booking confirmation.
Any special requests or verbal agreements must be confirmed in writing by HolAp. For package bookings made through other tour operators, their respective contractual and travel terms shall apply.
2. Prices, Additional Costs, Deposit, and Booking Fee
The published prices represent weekly rental rates for the entire Property. Ancillary costs (such as final cleaning, linen, and local taxes) are generally included, unless stated otherwise. Specific details are provided in the relevant Property description.
A non-refundable booking fee of CHF 50.– shall be charged per booking.
3. Payments
An advance payment of 30% of the total invoice amount is due within 10 days of receipt of the booking confirmation/invoice. The remaining balance must be settled no later than 42 days before arrival.
If the deposit is not received within the stated period, HolAp reserves the right to reallocate the Property without further notice.
For bookings made within 42 days of the start of the rental period, the full rental amount is payable immediately upon receipt of the confirmation/invoice.
Once full payment has been received—but no earlier than 28 days prior to the start of the rental period—the Tenant will receive a Rental Voucher containing the address, directions, and contact details of the key holder.
4. Number of Occupants
The Property may not be occupied by more than the number of persons stated in the booking confirmation/invoice, including children. The Service Provider or Key Holder is entitled to refuse access to any additional persons.
5. Pets
If expressly stated in the booking confirmation/invoice, one pet may be brought to the Property (subject to a surcharge).
6. Rental Period
The minimum rental period is five (5) nights.
The rental period commences at 16:00 (4:00 p.m.) on the day of arrival and ends at 10:00 a.m. on the day of departure. Further details are provided in the Property description or may be requested from HolAp.
7. Tenant’s Liability
The Tenant undertakes to treat the Property and its inventory with due care and to comply with any applicable house rules.
The Tenant shall be liable for any damage caused by themselves or their guests. Any damage must be reported immediately, or at the latest upon return of the Property.
Subsequently discovered defects may be charged to the Tenant if HolAp can demonstrate the Tenant’s responsibility.
8. Complaints
Any defects discovered upon arrival must be reported to HolAp in writing within 72 hours.
Any damage caused by the Tenant must be reported in writing within 7 days of departure.
Complaints, reduction claims, or compensation claims submitted after these deadlines will not be accepted by HolAp or third parties.
9. Events Beyond the Control of HolAp
HolAp accepts no liability for events beyond its control, including but not limited to natural disasters, strikes, political unrest, power outages, lack of water supply, blocked access roads, or increased noise due to construction work.
In such circumstances, the Tenant shall have no right to terminate the contract, claim a rent reduction, or seek compensation.
10. Liability of HolAp
If, due to unforeseeable or unavoidable circumstances (e.g., fire, water damage, etc.), the booked Property is unavailable, HolAp reserves the right to offer the Tenant an equivalent Property or to cancel the contract and refund all payments received in full.
Should the Tenant suffer loss as a result of a negligent contractual breach by HolAp, HolAp shall be liable for such loss, but only up to the amount of the agreed rental price.
HolAp accepts no responsibility for damage, accidents, loss, theft, or omissions caused by third parties.
11. Cancellation Protection
To protect against financial loss in the event of a serious incident requiring cancellation, a cancellation protection fee of 3% of the rental price shall be charged.
Serious incidents include:
- serious illness, accident, or death of a travelling companion or immediate family member (Covid-19-related incidents excluded); or
- serious damage to the Tenant’s property at their residence due to fire, natural events, theft, or water damage, necessitating their presence at home.
The Tenant must notify HolAp immediately in writing upon occurrence of such an event and provide supporting documentation (e.g., medical certificates or confirmations).
If the incident or illness existed or was foreseeable at the time of booking, no refund or waiver will be granted.
Cancellation protection begins on the date of confirmed booking and ends on the day of arrival. The booking fee and cancellation protection fee are non-refundable in all cases.
12. Cancellation and Amendment of Booking
Cancellations or booking amendments must be made in writing. Telephone notifications must also be confirmed in writing.
In all cases not covered by the cancellation protection (e.g., personal or business reasons, Covid-19, etc.), the following cancellation fees apply in addition to the booking and cancellation protection fees:
Timing Before Start of Rental Period / Cancellation Fee
- Up to 60 days: 30% of rental price;
- 45 to 8 days: 60% of rental price;
- 7 to 0 days, no-show, or early departure: 100% of rental price
Changes to the travel date or Property may be made up to 61 days prior to arrival, in each case subject to a handling fee of CHF 100.–.
After this period, the above cancellation terms shall apply; the handling fee of CHF 100.– will also be charged in such cases.
If HolAp successfully finds a replacement tenant, only the booking fee, handling fee, and cancellation protection fee will be charged.
For bookings exceeding 21 nights, the above cancellation and amendment fees do not apply and will be determined individually depending on the Property and duration of stay.
13. Price and Property Description Changes
Price changes or modifications to Property descriptions are unlikely but remain subject to alteration.
The same applies to price adjustments resulting from changes in government levies or significant currency fluctuations.
14. Governing Law and Jurisdiction
These Terms and Conditions shall be governed exclusively by Swiss law.
The place of jurisdiction is Locarno City, Switzerland.
